๐Ÿ” Why Construction Needs Due Diligence

Construction projects involve large sums, tight deadlines, and multiple stakeholders. A single bad partnership can cost millions. Our investigations uncover:

  • โœ”๏ธ Hidden director disqualifications and ASIC history
  • โœ”๏ธ Insolvency history of subcontractors and partners
  • โœ”๏ธ Phoenix activity in previous projects
  • โœ”๏ธ ATO tax debts that could become your liability
  • โœ”๏ธ Fraud, sham contracting, and "ghost shift" schemes

๐Ÿ“Œ Real Examples โ€“ How Host Companies Have Been Ripped Off

These are not hypothetical risks. These are real cases where host companies and taxpayers have been defrauded.

๐Ÿšง Metro Tunnel "Ghost Shift" Scam

On the Victorian government's $15 billion Metro Tunnel project, a labour hire firm (MC Labour) was allegedly involved in charging for shifts that were never worked. Two CFMEU delegates were sacked, and the fraud may have cost taxpayers millions of dollars. The government confirmed the matter is under investigation and could be referred to Victoria Police.

๐Ÿ’ฐ $10 Million Tax Fraud โ€“ Operation Bordelon

A serious organised criminal syndicate used labour hire and payroll companies in the building and construction industry to defraud the Commonwealth of $10 million. Six people were sentenced to a combined maximum term of 43 years in prison. The AFP restrained more than $20 million in assets, including properties across three states.

๐Ÿ“„ Labour Hire Licence Cancelled โ€“ False Invoices

BK Labour Hire Pty Ltd, a Victorian construction labour hire company, had its licence cancelled after an investigation by the Labour Hire Authority and Victoria Police's Hawk Taskforce. The company provided four falsified invoices to LHA โ€“ including one invoice that was never issued and three that were amended to falsify amounts and dates.

โš–๏ธ High Court Sham Contracting Ruling

A British backpacker was employed through a labour hire company (Construct) but required to work under an ABN for 25% less pay. The High Court ruled he was in reality an employee of the labour hire company, dealing a "savage blow to sham contracting labour hire practices" that rob construction workers of wages.

๐Ÿฆ Labour Hire Phoenix Syndicate โ€“ $2M Repaid

A labour hire syndicate used illegal phoenix behaviour to cyclically liquidate businesses, avoiding debts. Investigations found more than 100 people were employed by the syndicate's businesses โ€“ none of whom were paid any superannuation. The group was ordered to pay back more than $2 million, with over $5.6 million in liabilities raised.
